Hiring and onboarding employees in Tajikistan

If you are hiring a foreign employee, you need to consider obtaining the work permit first. Please see below. Once you agreed on the job offer with your future employee, you need to start the onboarding process.

Onboarding Process

The labor code of Tajikistan is a min act governing the onboarding of an employee. Once you agree to the terms and conditions with your future employee, you follow the process onboarding that is standardized and consists of the stipulated steps:
  • Step 1: employee writes a request to the director of the company;
  • Step 2: Employee signs the labor agreement with the company;
  • Step 3: HR department specialists fill into the labor book (employment record)
  • Preparation of the personal file of the employee;
According to Tajikistani, labor legislation companies can have a collective and individual labor agreement. If an employee will have property accountability, it is required to have a personal labor agreement.
Contracts can be indefinite or fix term contracts. Fix term contracts cannot be less than six months. Prolongation can happen only twice. After then, contracts will be treated as indefinite.

Probation Period

The trial period is only applied if stipulated in the labor agreement. The length of the probation period is three months. In some cases, the trial period cannot be applied. For example, an employee under 18 years, people with disabilities or fresh graduates.

Health and Safety

If an employee is working in circumstances that can affect the government may require the health or well-being of other people, medical and criminal records check-ups. An employer is required to comply with health and safety requirements by the law of the Republic of Tajikistan.

Work permits and Visas in Tajikistan

Visa Types

Types of visas are classified depending on the purpose of entry and stay in the Republic of Tajikistan. Visas are divided into the following categories:
  • Visa Type D – Diplomatic. This type of Visa is provided to diplomatic missions.
  • Visa Type X - Official visa. This type of Visa is provided to the official delegated of foreign countries.
  • Visa Type C - Investment visa. This type of Visa is provided to the investors or executives of the investment companies.
  • Visa Type K - Business visa. This Visa is provided for business people and their family members.
  • Visa Type M - Labor visa. This Visa is provided to people who are going to apply for the work permit.
  • Visa Type T - Tourist visa. This Visa is provided for the touristic visit of foreigners.
  • Visa Type 01 and 02 - Student visa. This Visa is provided to the student that is studying in the Universities of Tajikistan.
  • Visa Type XC1 and XC2 - Private Visa. This Visa is provided for private visits. The accepting side as citizens of Tajikistan. The inviting party is responsible for the stay of a foreigner in the country.
  • Visa Type MY - Free economic zone visa. This Visa is provided to the visitors of the free economic zone of the Republic of Tajikistan.
  • Visa Type H - Transport visa. This Visa is provided to the drivers crossing the territory of the Republic of Tajikistan.
  • Visa Type ID - Permanent residence visa. The Visa is provided to the people with a permanent residence permit in the Republic of Tajikistan.
  • Visa Type M – Media visa. This Visa is provided to the media workers of foreign media institutions.
  • Visa Type TR - Transit visa. This Visa is provided to the people that arrive at the international airport of Tajikistan for transit to another destination.
Application for Visa is submitted at the consulates and embassies of the Republic of Tajikistan in a foreign country.

Work Permit

A regular working hour cannot exceed 40 hours in a week. The duration of working hours is established at the following norms:

Foreign citizens to obtain a work permit in the Republic Tajikistan shall submit the following documents
  • application to the Migration Service of the Ministry of Labor, Migration, and Employment of the Republic Tajikistan
  • a passport or any other ID of a foreign citizen, and their copies;
  • a copy of the labor, free economic zone, spouse of a citizen (citizen) of the Republic Tajikistan, and a commercial visa.
  • registration card and copies;
  • receipt of payment for obtaining a work permit;
  • two 3x4 color photographs;
  • certificate of health received in medical institutions of the Republic of Tajikistan
  • copy of invitations or contracts between employers of the Republic of Tajikistan
  • tax identification number;

Working hours and leaves in Tajikistan

Working hours and overtime

A regular working hour cannot exceed 40 hours in a week. The duration of working hours is established at the following norms:
  • Five day work week, if otherwise, should be agreed with the employee in a labor or collective agreement.
  • For the employees of 15 to 16 years of age– 5 hours workday;
  • For the employees from 16 to 18 years old – 7 hours workday;
  • For a student that is working and studying at the age of 14 to 16 – 2.5 hours workday. From 16 to 18 years old – 3.5 hours workday;
  • For people with disabilities – 6 hours workday.
If a six-day workweek has applied, the workday cannot exceed 7 hours per day.
The total overtime shall not exceed 120 hours. The maximum duration of a work shift Is 12 hours. If an employee is working at a dangerous and harming conditions, the total overtime per day cannot be more than 2 hours.

Vacation leave

The paid vacation leave is of 24 calendar days. A larger number of days may be granted in the Labor Code of Tajikistan for certain categories of workers, as well as in the employment agreement.

Sick leave

An employee that due a sickness is absent from the job must inform its employer on the first day of the illness. If an employee is missing for more than three days, he/she needs to provide a certificate of sickness issued by the medical institution.
The reimbursement for the period of illness is paid as follows:
  • 60% of the salary is paid to employees with less than five years of work experience;
  • 80% of the compensation is paid to employees with work experience between five and eight years;
  • 100% of the salary is paid to employees with more than eight years of experience;

Maternity and paternity leave

Maternity leave starts 70 days before the child’s delivery. A medical institution issued an official document that proves the start of maternity leave. The period of maternity leave after childbirth is equal to 70 days. But it can be prolonged to 86 days in cases of complications in the health of the mother or a child. In case of delivery of twins or more babies, the afterbirth maternity leave is prolonged to 110 days. Maternity leave is calculated and paid at once from the Social Security Fund.
Child support is TGS 120 for the first child, TGS 80 for the second child, and TGS 40 for each subsequent child. The government also provides a childcare allowance of TGS 40 a month until a child reaches the age of 18 months

Remuneration & Benefits in Tajikistan

The minimum wage in Tajikistan is TGS 400 (USD 41); the average monthly nominal salary is TGS 1357 (USD140).

Employee termination and severance in Tajikistan

An employer can terminate the contract based on 13 reasons stipulated by the Labor Code. The listed below reasons are some of them :
  • Company liquidation or redundancy of the staff;
  • Lack of knowledge and qualification to perform the job;
  • Non-complying with duties and internal policies;
  • Absence at work for more than three hours, without eligible reason;

Notice period

An employee should be notified in person at least two months before the termination due to the company liquidation. If termination is taking place due to an employee’s inability to perform at the job is one month.

Severance payment

Severance payment that happens due to the company liquidation is one monthly payment. In case of termination due to the termination due to employee malfunction, there is no severance payment.

Payroll related taxes in Tajikistan

Employee taxes

An employee is paying Personal Income Tax in the following order:
  • 0% for the salary under TGS 40;
  • 8% for the compensation under TGS 140;
  • 13% for the settlement of over TGS 140;
The tax base is calculated as gross salary minus pension fund contribution of one present. For foreign employees, a flat 25% of personal income tax is applied.

Employer taxes

The rate of social security contributions for 2020 is 25%.
